National Military Memorial at Bangalore

Dear Military Vetarans,

This is a digital signature campaign to pledge support to the construction of National Military Memorial (NMM) planned and being executed by Govt of Karnataka at Indira Gandhi Musical Fountain and Park in the heart of the city near Vidhana Soudha, Bangalore.

However, some civilian groups residing around the memorial site are opposing the cration of NMM at the present site in the name of 'Environmental Distruction' and gone to the Court with a PLI.

This sacrifice shall be remembered by generations to come, while the National Military Memorial Park will stand as a witness to all their sacrifices, which is the reason why we have our freedom today.

This Memorial will be a peaceful, somber and inspirational space - a lush and forested Park with additinal 45-50 trees being planted inside the Park to increase the greenery and foliage.

Thousands of ex-servicemen here today gathered under the banner of the ex-servicemen wing of the SAD to work out a joint strategy to fight the battle of one rank, one pension.They held a “Wangaar rally”, a call for which was given by the national president of the ex-servicemen wing of the SAD, Colonel Pratap Inder Singh Phulka (retd).Addressing delegates from six states - J&K, HP, Haryana, Delhi, UP and Rajasthan, Phulka appealed to all organisations to unite and fight the battle. He said the rally was organised in the aftermath of the reply given by Deputy Defence Minister MM Palam Raju to a question raised by MPs in the Lok Sabha on April 19 this year. He had said no to the demand of one rank, one pension for ex-servicemen.Speakers of ex-servicemen organisations appreciated the SAD for passing a political resolution on May 20 in Chandigarh supporting the demand of one rank, one pension and lashed out at the Centre for “cheating” ex-servicemen.Ex-servicemen of various umbrella organisations pledged unity for this cause and vote en masse for political parties supporting their demands.To press for the demand, delegates of various ex-servicemen organisations said they would submit a memorandum with 1 lakh signatures in blood to the President.President of the district wing Col Surjeet Singh Cheema (retd) thanked ex-servicemen from all six neighbouring state for joining the movement to express solidarity for a common cause.

IESL is again MISGUIDING

In the Appendix attached by IESL the following has been mentioned :-



''Based on Report of the Committee on “One Rank One Pension and Related Issues” submitted on 30 June, although OROP has not been approved, pensions of all pre 2006 retired PBOR based on their rank and service has been brought on par. In case of officers of Defence Forces and civil service pensioners, it was already so''.



The above is absolutely WRONG . Their portion ''now'' highlighted in Red ( to emphasise) says , ''has been brought on par''. They (IESL) have very cleverly left out , 'on par with WHAT?


What has happened is that 'Pre 1996 pensioners have been brought 'at par' with 01.01. 1996 retirees affected by the 5 Th Pay Commission , the date of being 'at par' has been cleverly left out by IESL . Those who retired before 01.01. 2006 , affected by the 6 Th Pay Commission Award have NOT been touched and have NOT been brought any where close to those retiring NOW, i.e POST 01.01. 2006.



The difference of pension of the pre 01.01.2006 Sepoy Retirees and those who retire NOW as on 01.01. 2010 ,is still Rs 2958 /-without DA and with DA Rs 3993 ,as given in the table below:-

The IESL is MOST HUMBLY requested NOT to misguide us gullible ESM and accept the FACT that we are no where near OROP and JOIN IN THE STRUGGLE TO GET OROP.

It is TOTALLY wrong . The Officers have NOT been given any thing other than bringing 'PRE 1996' retiree officers 'CLOSER' much earlier to those who retired on 01.01.1996 and up to 31.12.2005. They are no where closer to those who retired on or after 01.01.2006 . This disinformation by the IESL has created an impression in the minds of JCOs and ORs that the govt gave some thing to the officers before giving it to them , there by weakening their (JCOs and ORs) resolve to get OROP and adversely affecting the UNITY between officers and other ranks .


Hon'ble Veterans are requested to examine the above and comment on the same . If I am wrong I will render an unqualified apology to IESL or any one else. They are also requested to ask IESL NOT to indulge in HALF TRUTHS PLEASE.

Why India is not a great nation

[ Major General Mrinal Suman, AVSM, VSM, PhD, commanded an Engineer Regiment on the Siachen Glacier, the most hostile battlefield in the world. A highly qualified officer (B Tech, MA (Public Administration) , MSc (Defence Studies) and a Doctorate in Public Administration) he was also the Task Force Commander at Pokhran and was responsible for designing and sinking shafts for the nuclear tests of May 1998. ]


As India celebrates 62 years of Independence, one tends to wonder: what makes nations great? Why is the US an undisputed world power? Why has Britain remained undefeated for centuries? Why has India succumbed to foreign rule so often? Why is India still struggling with internal dissensions and fissiparous forces? What does India lack?


A chance meeting with a British army veteran in a train from Edinburgh to London proved highly revealing. According to him, the secret of British success lies in the public support and respect extended to the soldiers.


`Soldiers` loyalty to the nation and readiness for the supreme sacrifice are driven less by material considerations and more by an overwhelming urge to earn love and respect of their countrymen. A grateful nation`s recognition of their contribution to national security acts as the strongest motivator,` he declared.


`Britain never forgets its war heroes. Every major landmark in London is named after distinguished soldiers and not politicians, ` he pointed out proudly. To prove his point further, he recalled, `Before World War II, it was not uncommon to see placards hanging outside some restaurants in Paris which read `Dogs, lackeys and soldiers not allowed`. On the other hand, even pregnant women used to get up and offer seats to soldiers in London buses. When the war broke out, France capitulated in no time while Britain remained undefeated.`


In an article written two days before the swearing-in of US President Barack Obama, his wife Michelle devoted 515 out of 863 words to the soldiers and their families. `So as I watch Barack take that oath, I`ll be thinking especially about those members of our American family who stand guard across the world and the loved ones who await their safe return... My husband and I are deeply grateful for the sacrifices that these families make to protect all American families. And we join them -- today and every day -- in praying for their loved ones and their safety. They don`t ask a lot in return, just a Washington that understands the challenges they face as part of their extraordinary commitment to our country... My husband understands that commitment, and he will ensure America lives up to its end,` she wrote.


`On Tuesday night, my husband and I will tuck in our daughters like we always do. Their bedrooms will be different, their home unfamiliar. But they will drift off to sleep protected by that same sacrifice that has kept all of our families safe and safeguarded our freedom for generations -- the sacrifice of our men and women in uniform and their families...For that, we could not be more grateful -- or more proud,` she added.


Now let us compare the above with the state of affairs in India. Can anyone recall a similar expression of sentiments by a national figure? Except for perfunctory platitudes on Independence Day, the Government has singularly failed to show compassion for the soldiers or tried to redress their genuine grievances. Apathetic political leadership and bureaucracy have made no attempt to understand the intensity of sense of hurt of the soldiers at their continued neglect and deliberate degradation.


Despite repeated representations, India still does not have a war memorial in the capital to honour independent India`s martyrs. India wants to ape the West in all sundry aspects, but not in matters that affect the well-being and morale of the armed forces. The Tomb of the Unknowns at Arlington in Washington, the Arc de Triomphe in Paris and the Cenotaph in London are admired by all Indian visitors. Yet the absence of a suitable war memorial in New Delhi does not appear odd to them. Surprisingly, it does not even hurt the conscience of the nation. There is no other country that can be so apathetic to the memory of thousands of soldiers who have laid down their lives for its security.


Our Urban Development Ministry is more concerned with the vestiges of the British rule, and opposes a war memorial near India Gate in the name of preserving heritage. India Gate was built in the memory of soldiers who died in World War I during the British rule. India has fought five wars since Independence and over 40,000 soldiers have made the supreme sacrifice. Opposition to a war memorial on frivolous grounds is an affront to the memory of martyrs and displays shameless insensitivity to the feelings of those who have lost their family members. But then, no political leader or bureaucrat can be faulted for their inability to appreciate these issues as they never send their progeny to the military.


Look at the treatment meted out to India`s tallest military leader, Field Marshal Sam Manekshaw, the architect of India`s greatest victory ever. It took the Government decades to determine and release his dues. India has not found him worthy of its highest national honour, the `Bharat Ratna`. No political leader thought it necessary to attend his funeral.


In Britain and the US, heads of the State with full national leadership would have made it a point to be present to pay a nation`s grateful respects.


Nelson`s Column at Trafalgar Square occupies the pride of place in London. London boasts of numerous statues of military heroes. No statues of political leaders are seen in the developed countries. India, on the contrary, has not found it necessary to honour Field Marshal Manekshaw`s memory whereas statues of political leaders (many with dubious credentials) dot New Delhi.


It will not be out of place here to recall the speech of President Obama at the Veterans of Foreign Wars Convention at the Phoenix Convention Center on 17 August 2009. He said, `You have fulfilled your responsibilities. And now a grateful nation must fulfill ours. Whether you've left the service in 2009 or 1949, we will fulfill our responsibility to deliver the benefits and care that you earned.` He described America`s commitment to its veterans as sacred bonds and a sacred trust Americans are honour bound to uphold.


`You have done your duty - to your fallen comrades, to your communities, to your country. You have always fulfilled your responsibilities to America. And so long as I am President of the United States, America will always fulfill its responsibilities to you`, he declared.


Contrast the above pledge and assurance with the apathetic treatment meted out to the ex-servicemen in India. In the recent past, India was witness to the most unfortunate sight of numerous military veterans returning their medals to the President to register their protest against the Government`s indifference to their pleas. Medals earned during active service are the proudest possession of soldiers, and their being driven to surrender them should have made the Government sit up and take note.


But true to its wont, it remained totally unconcerned and unmoved. Not a single Government leader or official has considered it necessary to talk to the protesting veterans to resolve the issues. This episode will certainly go down as a dark chapter in the history of Independent India.


India won the Kargil War of 1999 at a huge cost -- 527 officers and soldiers sacrificed their lives while over a 1,000 sustained battle injuries, many maimed forever. Yet, a senior Congress leader, Mr Rashid Alvi, had the impudence to state that commemoration was not warranted as the war took place due to an intelligence failure of the BJP Government. Every Indian soldier, both serving and retired, was aghast at the brazenness of the logic.


A notion has been deliberately perpetuated that the military must be kept under control through the bureaucracy lest it acquires political ambitions. Examples of Pakistan and Bangladesh are quoted to implant the fear of a military takeover in the minds of gullible and ignorant political leadership. A systematic and well planned strategy has been orchestrated to downgrade the military`s standing. The Sixth Central Pay Commission was the latest master stroke.


Although the public at large still holds the military in high esteem, a deliberate media campaign is being orchestrated by some elements with vested interests to show the military in a poor light. Instead of appreciating the military for initiating prompt disciplinary action against defaulters -- handful acts of misdemeanor and indiscretion in a 1.3 million strong organisation -- such cases are sensationalized to paint a negative picture of the services.


Historically, India does not have a culture of valuing its military. That is the reason that every invader succeeded in defeating and enslaving the sub-continent. If India survives today despite inept political leadership and the self-serving bureaucracy, it is only due to the unquestioned loyalty of the military and enormous sacrifices made by the soldiers.


Denigration of the military always proves fatal in the long run. Any country that discredits the status of its soldiers loses the moral right to expect them to die for its security. Great nations are distinguished by the esteem in which they hold their military.


No nation that stubbornly declines to honour the martyrs, respect the soldiers and care for the veterans can ever aspire to be counted amongst the great nations, slogans like `Mera Bharat Mahan` not withstanding.

ECHS: Budget allotment discriminatory



Dear All,

While interacting with HQ Western Command Officials on the issue of ECHS, it came to our notice another case of injustice to Defence Veterans by Government of India. Per person budget/ payment by Government of India is three times for CGHS i.e for elite Babus and 1/3 rd for Fauzi's ECHS. Can someone with contacts with media get it highlighted having duly confirmed. We have been cheated and are being cheated all over in daylight. Ministry of Finance gave us rank pay to be counted towards Pension in 4th pay commission, but Government of India denied it for so many years. When Supreme court gave us back rank pay, Government goes to courts.

You are right. Allocation ratio ECHS: CGHS IS Rs 2700: 5100 per head one third of the civilians. This is known fact and forms part of our brief/ projections to GOI wherever sent out.

If I understand correctly, when I joined the Army 40 years ago, free medical treatment for the rest of my life was one of the conditions of service. In fact my pay packet had this aspect among others like accn etc factored in. Hence what is the legality of I being asked to pay to become a member of the ECHS after retirement?

ANOTHER BRAVE SON OF UTTRAKHAND ATTAINED MARTYRDOM
Another brave soldier of Uttrakhand has attained martyrdom for the shake of the nation. Every Indian was proud for the son of Uttrakhand , Doonite Major Yogendra Singh Rajwar who was critically injured while fighting militants in the Bandipur village in Rajouri area of Jammu and Kashmir who was passed away on 5th May 10. He was serving in 7th Garhwal Riffles .

Major Yogendra was son of a Kargil martyr Major M.S.Rajwar who died in Kargil war. He was born in the year 1980 and did his schooling from Kendriya Vidhyalaya Clement Town and Military School. He joined Army as a commission officer during 2005. The martyr is survived by his wife Shivani Rajwar , five years old son Mudit Rajwar , mother Ganga Rajwar ,younger brother Akshay Rajwar and younger sister Neelam Rajwar.
On 4th May while fighting with militants for a long time he was hit by 3 bullets. He was admitted to Military Hospital Jammu where he succumbed to his injuries. Family members of Rajwar received a phone call from Army at 8:30 p.m that the Major had sustained seriously in a militant attack and has been admitted in Military Hospital, Jammu. After this news the family members had been praying for well being of Major Rajwar but the hope was dashed as they received information of his death.

On 4th May 10 when Major Rajwar called his wife and said that he had been hit by 3 bullets and to pray God for his survival. His wife thought that it was just a joke and she gave phone to Rajwar’s sister. But when the reality came in front of them, they all were busy in the prayer but there prayer didn’t work.

The deceased body reached Dehradun on 7th of May 10. His body was firstly brought to Mahendra Ground in Cantt area where the Army officer of various Army units and veterans paid homage to this brave soldier. At the same time, the relatives and other family members started reaching Major Rajwar’s residence from the time they knew the sad news to express their condolences.. People from every where including Ministers, MLAs, Defence Personnel, Bureaucrats, Police officers, and relatives started reaching at his residence to pay homage to the martyr who laid his life for the country. His body was than taken to Haridwar where it was consigned to flames after a gun salute given by the soldiers of 7th Garhwal Riffles. Snaps also attached)

Large number of Gorkhas and EX-Servicemen(Gorkhas) of Doon Valley honoured Chief Guest Sh Harbans Kapoor, Speaker Vidhan Sabha Uttarakhand on 8 May 10 at Pandit Deen Dayal Upadhya Assembly Hall Kaulagarh Dehradun for granting OBC for Gurkhas with cut of date from 15 Nov 03. Speaker Vidhan Sabha high lighted about dedicated efforts put in for this from the time of UP Govt and now with this all Gorkhas will be benefited in all respect like other back ward classes.
He stressed the audience for imparting the best education for children so that not only their future becomes brighter but also over all community and State also progresses. He assured for rendering all help for sorting out raised problems of the public during the meeting and invited concerned people at his place on next Wednesday evening for further discussing the issues so that appropriate action can be taken on all welfare points of the public.

Lt Col B M Thapa Veteran also raised the issue for granting the OBC for Gurkha Community from the Central Govt also . He also stressed that educational qualification for recruitment of Gurkhas should remain 8th class instead of 10th class which is presently advocated.

Govt Clogs wheels of Justice by Brig Harwant singh

Sir,


The govt is the biggest litigant and in November 2009, Supreme Court came heavily against its resorting to unnecessary appeals . Though it loses almost all the cases yet the wheels of justice are clogged for decades and people suffer. One simple example will suffice . Military officers were wrongly denied Rank Pay’ granted by the 4th Pay Commission. Officers finally got redressal from to the Hon'ble Supreme Court after 24 years. Rather than gracefully honouring the verdict , the govt has appealed for reopening of the case and cancellation of orders It is nothing but delaying tactics and shows Govt’s callous attitude towards its military . Is it not enough that the Officers have been made to suffer from January 1986 and in the mean time some of them have even died? Law Minister in the recently concluded ‘‘All India Conference of the Central Administrative Tribunals’ , advised that that Government should go in litigation only where it is absolutely necessary. Will the bureaucrats please take the advice ?

Views of Col Raman

Dear Veterans,

The diktat of Brig Kamboj, as given below, may appear to be abrasive at the first glance. But he has every right to be so, since he has been working tirelessly for the past two years, for the cause of IESM. The call now for the burning of effigies, was preceded by another similar but much more violent call for putting out the Amar Jawan Jyoti at India Gate, last year. There was tremendous amount of protest against the very thought of such a diabolical act by the Veterans.

We are all lambasting the Govt, for the way in which it is trying to stall, even the settled case of Rank Pay. To me, it appears to be a very strong case favouring the Veterans. My suggestion is for the IESM to take the legal course of action, where success is more or less guaranteed.

A court ruling in favour of Veterans will have an electrifying effect through out the Nation, than burning of a million effigies. The latter course of action, ie., burning or any other act of vandalism, will only tarnish the image of ESM for ever.

We may argue that since we are out of uniform, we have become civilians. Then why agitate for OROP, which is exclusively for the Veterans? If, as Veterans we are projecting some demands, then it is mandatory on our part to project our image also, as a disciplined & patriotic body with strong sense of dedication to the Nation.

We have shed only our uniforms. But NOT the honour & prestige attached to them.

The Indian Purple Foundation (TIPF) is a group of military officers who took premature retirement a few years ago and have made a successful transition into civilian life. The Foundation aims to provide a platform for serving and retired military officers to share experiences and exchange views on various aspects of a switch from uniform to civilian life.
The TIPF has organised a "Career Transition Seminar" on 13th Jun 2010 at USI Delhi. The seminar is aimed at an audience of those who are close to retirement, have opted for, or are considering, a premature retirement, and for others who may be plain curious to know more about the eventuality of such a transition. The seminar will have an impressive group of speakers, who have volunteered to share their experiences and ideas with those who wish to hear about the many options and nuances of such a career shift.

Dear Brigadier CS Kamboj, VSM., VETERAN:

I have been following up most of the recent mails from your good offices. Much has been said and repeatedly addressed to the PM, President, Minister Of Defence by our learned veteran writers. Of course the letter from Maj Gen (Retd) Satbir Singh, SM Vice Chairman Indian ESM Movement dated 23 April 2010 to the RM, PM, Smt. Sonia Gandhi, Chairperson UPA & National Advisory Council and three chiefs, quoting all the decisions of the Supreme Court and the AFTs was impressive and should bear fruits, if read. And the situation is that we do not know if these communications have even reached their hands. I suggest, we may file repeated demands using 'RTI' to gain information from respective secretariates , if the same have reached the hands of respective hands or not and when and their responses. This may ultimately be useful in either our gaining success or mounting pressure. At least we may account on counting the denial of even this information.

I wanted to inform you that I am at present in New Jersey in the US till September 2010 and you may contact me for any assistance that I may be able to render from here.

I agree with Rakesh. One should pickup any subject with which he has knowledge & inclination.

The most live subject is 4th Pay Commission - Rank Pay which effects both Serving & Veterans. I had sent papers pertain to Rank Pay obtained under RTI to Maj. Gen. Satbir Singh SM.

These will be of immense value when a counter-affidavit is filed in the Supreme Court. These papers prove that the Ministry of Defence (finance) had objected to the way Pay was fixed by the MOD & had anticipated that it will not stand the scrutiny of Law.

The MOD had suppressed this letter from the PM & instead attached a Note from Ministry of Economic Affairs with the Note to the PM, who approved the same.

It is a clear case of intentional fraud by with MOD Bureaucrats with the Armed Forces. The matter was reported to the CBI Chandigarh who forwarded to CBI Delhi who took no note of it. These facts are included in my E-mail to the PM. It appears no note is taken by any one.

Three courses of action are recommended. One. The Papers with Maj. Gen. Satbir Sing SM be shared with the group filing the counter affidavit & prayer may include; action be taken against who committed this fraud. Two. All NGOs may contact respective MPs & convey a common draft to them for exposing Ministry of Defence in the Parliament. Three. The Armed Forces may adopt QSIR to say that the morale of the Officers is effected since those who are supposed to protect the interest of the Soldiers are working against them

The three courses of action postulated by Brigadier Ghuman, eminently deserve serious consideration and action towards implementation for the good of all serving and retired personnel of the Defence Forces. It is very important that the perpetrators of these shenanigans nearly 25 years ago are identified, pursued and made to account for the fraud committed on the Defence Forces.

Unless they are held accountable and made to pay, this story is going to be repeated with impunity by the Babus, even more brazenly in the future. And, the accountability should also include the Cabinet Secretary, the Defence Secretary, the concerned staff of the MOD, the Secretaries on the Ministry of Finance, including the Department of Economic Affairs, the then CGDA/CDA's, etc. Even the then Defence Minister should be made accountable, as after all, the 'buck' should rightly stop with him. Indeed, it would be then realised by the Babus and the politicians, that 'nemesis' always catches up and the long arm of the law does take its course, notwithstanding any delays, along the road to justice - 'Be you ever so high, the Law is above you".

A plea to this effect should be included in the 'Counter' that will have to be filed before the SC, making it as a stand alone plea, apart from other relevant pleadings on behalf of the Serving and retired personnel, both pre-1986 and post 1986, in the interest of deterrent against a repetition of the same scam in the future. In addition to any civil/criminal action, they should also be made to pay a financial penalty.

Besides, the current lot of Babus - the Cabinet Secretary, the Defence Secretary, The Secretaries in the Ministry of Finance and particularly the Expenditure Secretary Shushma Nath, the Legal Section of MOD and other officials, the present CGDA/CDA's, etc., should also be made as respondents. Even the present RM should be called account and asked to explain what issues/ circumstances prompted him to approve the filing of this misguided appeal. All this is essential to preclude any such repetitions in the future.

Lastly, it is necessary that as many of the Veterans across the whole of India should be made plaintiffs, as there is message in numbers and also to prevent the Government from pleading that the benefits be restricted only to the litigants. The IESM should therefore, implead itself on behalf of all its members. This applies to all other Veterans organisations as well. All should be ready to contribute towards a worthy and beneficial cause. As the numbers will be large, the contribution level is likely to be nominal.

Mr Anthony gave a stealth blow beneath the belt. Let us not panick. Any quick knee jerk reation will do lot of damage. The game being played is to gain time and pass on the buck to the next Govt. Secondly it hurts their political vote catching plans of doling out money. So much surprising is that we are not asking for any favours. We are asking for our legitimate dues. Having robbed us and our families for 25 years MOD is playing their favorite game of litigation. It anger should be expressed in parliament.

Let us stick to the Panchtantra saying :

"UNITED WE STAND and DEVIDED WE FALL".

MOST IMPORTANT FEATURE OF THIS CASE IS THAT IT AFFECTS NOT ONLY THE RETIRED BUT ALSO THE SERVING OFFICERS. I AM SURE AT LEAST TWENTY FIVE THOUSAND SERVING OFFICERS ARE AFFECTED. IT IS FOR THE CHIEF TO STAND AND UP AND ASK THE CDA TO RECTIFY THE WRONG.

We must also insist the culprits should be punished.

Is there NO ONE IN THE COUNTRY (OPPOSITION---BJP, Left, SP, RJD. BSP etc, OR our dear SUPREME COMMANDER or JUDICIARY or RULING PARTY i.e. UPA-II) who can see the truth/realty/injustice to the Nation/Public (at large & the personnel of the Defense Services, both Serving/IESM; in particular) and raise their voice against the INJUSTICE being done to ALL THE DEFENCE SERVICES' PERSONNEL ( both SERVING and RETIRED) who are directly affected due to the game played by the AUTHORITIES, RESPONSIBLE FOR IMPLEMENTING the awards of the CPCs. EVEN THE SERVING PERSONNEL too would be directly affected by the increase in their Pay Scales.....as a result of higher basic pay, after the award of IV CPC and also the subsequent awards and also the FUTURE CPCs..which are based on the last pay drawn. This is causing such a SEVERE BLOW TO THE PEOPLE IN UNIFORM and whose morale (and hence the health of the Nation) is directly affected by such IMMORAL ACTS.
I am surprised that these things (i.e. filing of review petitions and all) are happening during the premiership of one of the best and highly educated & respected (and not an illiterate POLITICIAN---in the real sense) PMs of Independent India.
I pray to God that good sense prevails in the minds of the POWERs that be and they do not take the DEFENCE SERVICES for GRANTED and it does not BOUNCE BACK. The politicians will realise this on their own peril BUT BY THAT TIME IT MAY BE TOO LATE!

LET US INITIATE SOME DRASTIC ACTION and MAKE IT A MASS MOVEMENT.

It is disgraceful that the Union of India-MOD has moved the Hon’ble Supreme Court of India appealing for reopening the case and requesting them to limit their judgment to only those appellants who submitted writ petition in different courts and call all records from there and then decide on merit. It is nothing but further delaying tactics. Is it not enough that the Defence Officers have been made to suffer from 1.1.1986 and now when the Hon’ble Supreme Court has set the matters right they are again being asked to reconsider.

They should have gracefully accepted their fault and taken prompt action to close the chapter, to save their face, by rectifying the mistakes. Actually the Hon’ble Supreme Court has let them go cheaply by just imposing 6% interest on arrears and without casting aspersions or punishing the culprits who openly flouted the rules and Court Judgments and did not follow the laid down Court rules and precedents.

As we all know Rank Pay was introduced by the IV Central Pay Commission as Special Pay and was to be paid in addition to the substantive pay of the post/ rank held. It was shown on the Pay Slip as Rank Pay paid but instead of giving additional pay, as sanctioned by the IV CPC, an equivalent amount was deducted from the substantive Pay, fixed for the Rank This amounted, to not only denying the officers the additional rank pay but lowering the Basic Pay, in comparison to their counter parts in civil, on which status, DA and other allowances are worked out. This Rank Pay became double under the 5th CPC award with 100% merger of DA but the increased portion was only paid as Rank Pay and the earlier
deduction continued. The 6th CPC too based their data on the same
less basic pay.

The Hon’ble Kerala High Court in their judgment P.P.No.2448/1996 and as confirmed by the Division Bench of the same High Court in W.A.No.518/1999(Appeal) pointed out that the respondent 2 & 3 – MOD and CDA(O) respectively, had completely misunderstood the scope of extending the benefits of the rank pay to the Armed Forces Officers. As rank pay is some thing which was given to the Army Officers, for peculiar service conditions, in addition to the existing pay scale as was notified in the GOI Gazette dated
18.3.1987. Further. the Court held that the provisions incorporated in Para 6 of MOD Instructions dated 26 May 86 have been found contrary to and without any substantive authority of the Govt. decision stipulated in Min. of Finance and MOD Notification dated 13.3.87 evidenced as exhibit P1 and R1 on record of the case and the said deduction was thus held inadmissible in law. And Para 6 thus stood annulled.

Once SLP No. CC-5908/2005 filed by Union of India against the Judgment of Hon’ble High Court of Kerala was rejected on 12.07 2005, the MOD should have, amended Para 6 of Mod Instruction dated 26 May 86, which was held ultra- vires by the Hon’ble Court, besides paying back the deductions made to the
appellant. It amounts to contempt of court.

Secondly, as there was a Judgment of Hon’ble Supreme Court already available where the Court had directed the Govt. that where a judgment has been delivered in one case and similar faults/ mistake is noticed/ reported in some other case, the concerned departments should set right the similar mistakes, as
pointed out in a particular case earlier, without referring to the Court again. Based on these directions MOD had many times rectified such mistakes and differences were either paid or recovered without reference to any court of law. Similarly, in this case, Officers should not have been made to go to courts and the MOD should have settled the cases accordingly at their own rather than delaying it for so many years. It has unnecessarily delayed matters and amounts to a criminal offence to deny so many officers their dues for so many
years and make them suffer with less Pay and Pension, especially those who have left us during this long period and family pensioners. It lowers the morale of the troops.

It took more than 20 years to get final judgment of the case The matter was heard and finally disposed of by the Hon'ble Supreme court by the Bench of Hon'ble Mr. Justice Markendey Katju & Hon'ble Mr. Justice R.M. Lodha today i.e. 08.03.2010 (Court-7, Item-84). The Apex Court has held that the judgment dated 05.10.1998 of the Hon'ble Single Judge of Kerala High Court in P.P. No. 2448/1996 as confirmed by the Hon'ble Division Bench of the same High Court in W.A. NO. 518/1999 (Appeal) was correct and reasonable and as such the benefit of this judgment be extended to all eligible officers of Armed Forces.
The Hon'ble Apex Court awarded 6% interest on the amount due to the officers. The Hon'ble Supreme court disposed of the transfer petition and allowed the writ petitions of the petitioners.

In spite of clear violations of the rules and Court judgments, going again to Court is a deliberate attempt to delay matters and sub verge justice. It is also contrary to the instructions issued by the Ministry of Law and Justice, Department of Legal Affairs, New Delhi vide their Office Memorandum No.1-28015/01/2009- Admn.IV(LA) Dated 3rd Sep. 2009 where they have advised different Govt. Ministries /Depts. who keep on making repeated references insisting for concurrence of this Department to agree to a particular course of their action which is not legal. It is observed that there is a tendency of filing frivolous petitions/appeals till the highest Court decides otherwise. Once a
considered view has been expressed by this Department and there are
Judgments by the Apex Court on the subject, such petitions to Courts amount to clogging Judicial System where there is already a huge pendency. We hope the Ministry of Law and Justice intervenes and advises them to withdraw such cases and make immediate payments as ordered by the Hon’ble Supreme Court.

If they insist on such tactics, we pray to the Hon’ble Supreme Court to deliver an exemplary judgment punishing officials who indulge in such nefarious acts
denying even Defence Forces their due.

Shorn of rhetoric, and fluff about HR, Sadhbhavana and so on( op/tac concerns are best left to incumbent cdrs/& neither quite featured in my earlier Post?) , the real issue at hand was 'recasting of AFSPA.'. The article's cautionary intention is well served and fully taken. But it is also important that such 'status-quoism' should not become dysfunctional to the 'overall aim/obj' of ops- after all AFSPA is an instrument for facilitating ops. What is the 'strat/key obj' in this form of warfare? Obviously not 'capture of territory/kill ldrs/recover wpns' etc, which are, at best, proximate tac objs.
5. Here I wish to assert with full weight (and humility) of an Inf professional 's experience( of leading from a Pl to an Army), specialised trg and more than a fair share of CI ops of various kinds, that at Op level the superordinate OBJ is regaining/retaining the LOCAL SP. Lose that and you cannot win.Therefore, anything that would seriously hurt this 'Op Imperative' is counterproductive. It is my case that presently in Manipur ,inter alia, we are at such a critical juncture, when pragmatic flexibility/ mil statesmanship is needed, without in any way relenting in op intensity.
6. I also profess faith in the professionalism of our legal experts , who with the right mil advice , can innovatively recast the legal package/protection, so that it fully enables effective ops. Regrettably, such thinking is reflexively attributed to 'bleeding heart pacifists or HR lobbies. I belong to neither nor have lost the 'big picture' or concern for our tps..
7. It may be interesting to research if all the Armies that have engaged in LICO in the past 100 yrs or so-ranging from Malaya, Kenya, Cyprus, VietNam, Afghanistan, , Chechnya ,Sri Lanka and so on- had a copy of our AFSPA as a legal prophylactic.Sure, they must have had something similar, even more stringent; but it shows that other AVTAARS of the Act are possible.Then why this phobia and fixation about the scope for sensible reform. It is needed in self interest of the SF and is a compulsion of the strat context, as obtaining in some sectors.
8. Being argumentative and change-resistant are characteristic of our civilizational values-in some ways these are virtues. Those still not persuaded by my argument are welcome to disagree-Kal Chakra/time will validate the right choice, in due course.
