I was away on a pleasure trip with family for five days – not allowed to even look towards my laptop.
Came back dead tired – so another day gone sleeping.

Over 500 emails in my in box, including 106 emails for becoming member of email service of "REPORT MY SIGNAL".
(never before such large numbers applied at the same time – I am amazed. I think total numbers may now reach around 1900 individuals & about 55 ESM Groups. A very good sign of ESM mustering together).

Registering one member takes around 10 minutes – I will definitely register all new members who havae already applied and even more - but it will take time.
Kindly tell your friends to kindly forgive me for the delay in their receiving direct emails from me.

Other emails – I will pick up depending on proper subject headings etc. Whatever old emails I can clear in next two days – I will.
Rest have to be just deleted otherwise I will continue in arrears for long period.
If your important email does not appear in next two days – please re-send it.

Candle-lit vigil by ex-servicemen




Chandigarh, August 30

Ex-servicemen from the Tri-City today held a candle-lit vigil in the Sector-17 plazza in support of their demands, including grant of “ONE RANK, ONE PENSION” (OROP). A large number of ex-servicemen and members of their families, carrying candles and placards, participated in the vigil. Ex-servicemen said instead of sincerely considering their demands, the government seemed to have further hardened its stance against the veterans. The government had not yet accepted the report of the standing committee on Defence tabled in the Lok Sabha on May 7, strongly recommending the grant of “ONE RANK, ONE PENSION” to Defence personnel. They also criticised the government for continuing to contest the court rulings that were in favour of Defence personnel, filing appeals even against the policy of the law ministry. They said the Defence community, especially veterans, were feeling angry, hurt and aggrieved. All efforts, including peaceful protests, had failed to move the government, which continued to deprive them of their legitimate dues. Ex-servicemen also raised issues like consistent downgrading of status of the armed forces personnel across the board, leaving out of widows from the recent enhancement of pension to JCOs and Jawans, no enhancements in pension to the aged and old reservists, anomalies in pension and non-implementation of court directives.

Others will relay tomorrow and I hope all appears will cover the event. There were almost 250 officers and their lady wives and children. Number was less, considering short notice and first time. In a very short time from 1930 to 2030h bonhomiewe established was really very heartening. In fact our ladies wer more enthuastic than Veterans.Many of them spoke to the media very well. Brig BS Gill,Vrc,Maj Gen Pushpinder Singh,Maj Gen RS Batra,Brig KK,Brig Opinder,Brig Harwnt,Brig Gill and there were far too many other senior officers whom I could not meet.Media gave full support, so was the support from Local citizens. Even Chandigarh Police was supportive, we did not know that we cannot hold rallies at sector 17 WO permission, but we did. Next time we will take advance permission.Yesterday, there was a rally at Patiala, today Chandigarh next week Monday at Gurdaspur. Then all over in all cities of Punjab. We will request to hold such rallies all over India. One it is easy to hold, second it is peaceful, third everyone including ladies feel happy to participate, four it is very low cost almost and last like insurgency it gives more dividends. It will generate a good pressure; fact that two channels covered live speaks for itself.I propose next one at war Memorial Chandigarh for Tri City again during Day on 16 December and again peaceful without speeches but, call all media.an have picnic. We can interact amongst ourselves and media in small groups. Weather will be good. Please give views.Lastly, I express my thanks to all veterans and their lady wives for participation and please be part of the group in future too. It was again a very good experiment at Amalgamation of all ESM organisations which worked; everyone rose above party lines. Educating the youth...Kargil War - CD- Projection in Schools by Col Raman

Dear Veterans,

On 27 Aug 10, I had an opportunity to talk to the students of 11 & 12 Standards in Lady Sivaswamy Higher Secondary School, Mylapore, Chennai. A total of 200 Boys & Girls, with their Class teachers attended the Presentation. The Presentation was done in the School's Auditorium.

There are certain points I wish to bring out to the Veterans, who may be addressing such audience.

The students are captive audience, well mannered & disciplined. They want to learn more about the Army way of life, especially the career prospects & promotion avenues.

Kargil war is now more than 10 years old. Most of the students of 11 &12 Standards, would have been only between 7 & 9 years old during the time of the war, ie, in 1999. They would not have been watching the TV during that period, in a serious way as the older people would have been doing. Therefore, I request the Veterans to kindly prepare a brief introductory speech, covering the background to the conflict, lasting for just three minutes. The DVD can be projected after the introduction.

Some inquisitive students ask questions. Some of the questions I faced are as under:-

Why the guns keep firing when you do not see any enemy?
Why hand over the dead bodies of enemy soldiers with ceremony?
Did they (Pakistanis) also hand over the bodies of our soldiers in a similar way?
In the modern days, there are missiles, rockets & laser guided bombs available. Then why sacrifice the youth to physically capture every peak?

Kindly prepare yourselves to face more of such questions.

With recent developments in the parliament of sudden enhancement of MP, s pay by 300% and RM, s statement on “One Rank One Pension”, Veterans are once again agitated.MP; s pay rise has angered the public and the Media for having double standards. Most electronic media channels debated the issue where they preferred to call mostly Defense Officers for comments. Martial of The Air force Arjun Singh, Senior most Serving Officer of Defense Forces commented that he sat on Dharna after his retirement for OROP 25 years back at India Gate and Defense Forces pay anomalies are still existing. Media and citizens are arguing that MP,s enhanced their own emoluments by 300% with one day debate ,whereas Veterans have been fighting for it for the past 30 years.
Indian Exserviemen Movement which came up at national level in 2008,gave a call for OROP which really picked up momentum amongst ESM.They have deposited their 60000 medals with President,five lakh ESM have submitted memorandum to PM duly signed with their blood,they conducted rallies thought the country.Now they have decided to conduct candle light marches in all cities of India,finally culminating into rally at New Delhi from India Gate to Supreme court of India.
Large number of Veterans collected at Sector 17 –Fountain along with their families and Children.They were anguished on contradictory statements made by Defence Minister that, it will take long time to implement OROP,when MP,s enhanced their emoluments over night.There were almost 2000 Veterans carrying candles in their hands and lighting them close to Fountain with hope and determination to succeed.Who knows what Bureaucrats and politicians have designs in their hearts for them.It was very heartening to see that Media and Citizen were very supportive of their demands.
They have also declared that they plan to hold larger rally at Chandigarh War Memorial on 16 December at 11 AM onwards and declare 16 December that as “Veterans Day”. All Veterans will wear red Ribbons on their left pockets to show respect for martyred soldiers and determination to fight for injustices.Amongst Veterans were many very old Senior Generals.

One-rank One-pension will take time: Antony

New Delhi: Even as ex-servicemen take the extreme step of returning their medals demanding one-rank-one-pension, the government on Wednesday clarified that it may not come very soon.

Replying to a zero hour mention by Leader of Opposition in the Rajya Sabha Arun Jaitley (Bharatiya Janata Party) and supported by members across party lines including the Congress, Defence Minister A.K. Antony said that the implementation of one-rank-one-pension is an ongoing process.

"At the time we cannot implement one-rank-one-pension, but we are nearing the goal. It is a long process," Antony added.

Raising the issue, Jaitley said that though it was mentioned in the budget speech of Finance Minister Pranab Mukherjee, no steps have been taken so far for implementing the one-rank-one-pension system.

"Neither the 5th nor the 6th Pay Commission addressed the issue. The finance minister also indicated in his budget speech that a committee will be formed but nothing happened," Jaitley pointed out.

He also said that ex-servicemen should not take extreme steps like returning their medals.

"The medal is an honour given to them by the nation. I therefore appeal to them not to return the medals," Jaitley said.

He was supported by Communist Party of India-Marxist member Sitaram Yechury and Congress member P.J. Kurien, among others.

"I would also request the Government to look in the issue of thousands of jawans who retire before the age of 40," Kurien said.

The Defence minister, however, said that though one-rank-one-pension was still far, a number of steps have been taken by the government to ensure that ex-servicemen are benefitted.

"The Prime Minister appointed a committee to look into the issues of the ex-servicemen. The committee gave recommendations in five areas and all have been accepted," Antony said.

"Government has increased the pension of nearly 12 lakh ex-servicemen. We are also starting 197 additional polyclinics for them across the country," he pointed out.

The opposition, however, remained unsatisfied with the reply as BJP member S.S. Ahluwalia urged the government to talk to the ex-servicemen and settle the issue.

Over 5,000 ex-servicemen on Sunday returned their medals to protest the government's reluctance to accept their one-rank-one-pension demand. They also submitted a memorandum on the issue to President Pratibha Patil, the supreme commander of the armed forces.

FEEDBACK DISCUSSION ON OROP ON PTC PUNJABI ON 26 AUG -2030 TO 2110 H

1. There was a very lively discussion on PTC Punjabi channel on 26 Aug at 2030h on OROP.

2. Panelists were Brig HS Ghuman,Brig Nawab Singh,Col Boparai,Prof HS Mehta,Mr Bains Media Advisor to CM Punjab.It was conducted by Mr Ritesh Lukhy.

3. I made following main points.

A. RM has said in the parliament that they were near the goal and it will take long to implement OROP.Marshal of Air Force Arjun Singh,Senior Most Serving defence Officer, has said on TV that he sat on Dharana at India gate 25 years back when he had just retired to protest for OROP.RM says it will take time,they have taken 25 years now and if they take 25 more;will they pay soldiers in cemeteries and graves?

B. ESM agitation started 30 years back,since 2008(At The Time of 6th pay Commission) IESM was formed and we agitated by returning 6000 medals,submitting Memorandum to PM signed with our blood,carried out rallies in whole country and now planning candle light marches in whole country.Still no reaction.Do they want us to agitate like Maoists?We are Disciplined soldiers and pushed to a wall,we may take any steps.

4. Following points came out from other members.
A. Financial impacts are not much.
B. Pakistan and Chinese armies pay their Veterans so well.
C. main reason for Young Cream not joining Army is that they see Veterans agitating for additional Pension.
D. Most civilians already get OROP.Rest cannot compare with defence forces.
E. Punjab Government will pass a resolution and write to Central government to grant OROP pay to Veterans,it was assured by Media advisor to CM.
F. All citizens support OROP.
G. Media and Citizens feel Government sis still not serious in granting OROP.They are still fooling soldiers.

5. I announced on PTC that we are holding candle Light March at Chandigarh on 30 Aug at 1930h at Sector 17,Fountain area.

He has requested veterans to have little more patience, as the Govt proposes to tackle this issue step by step.
I thought I wlll share tis news with you and others woh may have missed out on this.

Dear Sir,

I was shocked to read the unfounded allegations by Mr Praveen Davar of the AICC ( IE, 24 Aug 2010) that members of Indian Ex Servicemen Movement (IESM) were returning fake medals and signing the memorandum with some red coloured chemical and not blood. I think Mr Davar is an ex Captain of the Army himself. By making such allegations he has proven that he was not fit to remain in the Army.

I have myself returned my genuine Param Vashist Seva Medal (PVSM), unless I was given a fake one at the Investiture Ceremony by the Supreme Commander. He is forgetting that a father not only returned his own Sena Medal but also returned his son's Shaurya Chakra, awarded posthumously. Many others have returned their Vir Chakras, Sena Medals,PVSM, AVSM and VSM along with their service medals. As regards the fake blood allegation he forgets that the blood was drawn by the para medics of Delhi's well known, Dr Lal's Path Lab. I assume that he has got the backing of the in house detective agency of the AICC ie., CBI, to make such wild allegations. AICC may be inviting legal action from ESM who have been hurt by Mr Davar's sycophantic statements.

I doubt Mr Davar has a medal he can claim as his own, otherwise he would not dare make such preposterous statements and hurt the feelings of the ESM community. They have already been hurt enough by the President and so called Supreme Commander, who has no time or feelings for her ESM.

Thank God, Davar has exposed how the Congress party functions! Unfortunately for the congress party and fortunately for the nation, the soldiers, past and present, are too honourable and upright to think in terms of collecting fake medals and signing petitions in fake blood. Well, one doesn't know whether the Govt at the Centre, headed by the Congress for most years after 15 Aug 1947, has been/ is presenting fake medals to the soldiers.

Coming to the question of availabiltiy of fake medals in the market, doesn't the ruling party's spokesperson find anything illegal in it that needs investigation? If such medals were available in the open market then why should young soldiers sacrifice their lives for the non-existant glory attached to such medals? Those aspiring to joining the armed forces may also give this a thought!

Better still, in an attempt to discredit the leadership of IESM, by mentioning that Gen Kadyan is a senior member of the CommonWealth Games Organising Committee (CWG OC- a name that is uttered with utmost repulsion by every knowledgeable Indian!) , Davar has unwittingly added fuel to the scandal that the Govt, headed by his party, has been trying to cover up!

It is also regrettable that a media of IE's standing has published this baseless allegation without verifying the facts which it could have done easily. After all Jantar Mantar- the scene of all rights related activities- where the returning of medals and signing of the petition took place was never inaccessible to the journos who should be following the foot steps of the great Goenka, the one and only media person who had stood up to the Emergency!

Address issue of one rank one pension, Govt told

Members cutting across party lines on Wednesday urged the Government in the Rajya Sabha to address the issue of “one rank one pension” demanded by ex-servicemen and expressed concern over the ex-soldiers returning their medals as a mark of protest.

Defence Minister AK Antony, however, said it was not possible to implement one rank one pension in one stretch as it had several implications. The Government had implemented recommendations of a high-powered committee and more pension benefits to the soldiers were one of the steps towards one rank one pension, he said.

Raising the issue after the Question Hour, leader of Opposition Arun Jaitley maitianed it was a sad spectacle to see ex-servicemen surrendering their medals as a mark of protest on the issue.

He urged the Government to address the matter and appealed to the ex-servicemen to desist from resorting to the extreme step of surrendering their medals. The entire House supported Jaitley’s appeal.

Responding to their concerns, Antony said implementing the award in one go was difficult. “In one stretch, we will not be able to implement it but we are near that goal... It is a long process,” he said.

Dear Veterans,

Every Veteran would have been busy listening to Maj Gen Satbir Singh's 9.30 interview on NDTV. Though he could not reach the studio, his voice could be heard loud & clear. The transcript may also be made available in a couple of days.

I was fortunate to see the interview in 'Times Now' of Marshall of the Air Force, Arjan Singh, the senior most veteran amongst us today, conducted by Arnab Gosami at about 9.15 pm.

The Marshall was categorical & emphatic in his views:-

The demand of OROP is absolutely legitimate.

The Veterans are demanding this for the past 26 years.

26 years back, he himself was involved in one of the stirs, when VP Singh was forced to have a conciliatory dialogue with the agitating ESM.

On a question from Arnab, he said that the return of medals is not a good thing & he is very disappointed for having come to such a pass. However, such an act should be viewed as sending a strong message by the Veterans & nothing more to it.

On another question whether the Central Govt Servants may also resort to such demand, he said that the criteria of soldiers are entirely different than those of Civil Servants. The two, therefore, are not comparable at all.

In both the interviews, the browbeating of the Govt by the MPs into submission, figured. They have now got Rs 10,000/- more to their already secured 300% hike. We wish them well & hopefully, atleast from now on, they will start discharging their constitutional duties.

But they had succeeded in initiating the domino effect. Now, the Members of Legislative Assemblies of various States, have laid their claim on similar lines.

The impact of the IESM Rally on 22 August, has really caught on the imagination of the Media of both versions.The Hindu & Sun TV have also come out with full coverage.

Gen Raj Kadyan's mail today exhibits the similar buyoncy, getting a word of support from a Police Officer, who said that we deserve it.

Mr Salve`s presence and his concern was heart warming. His offer for legal assistence need to be discussed and deliberated for obvious reasons , which i am sure Gov Body would do.

Hope and pray that fence sitters particularly among officer class, quite a few of them inquiring when we come across, "" ARE BHAI, YEH BATAO KEH KUCH HOGA? New Delhi: With ex-servicemen protesting over the one-rank one-pension issue, Government today said the main aspects of the demand have already been addressed which are benefiting around 12 lakh personnel.

"The main aspects have already been addressed in-principle and there has been a substantial addressing of the issue and I think 12 lakh personnel below officer rank have benefitted because of these decisions," Minister of State for Defence M M Pallam Raju said here.

Ex-servicemen have been demanding equal pension for personnel retiring from the same rank irrespective of their date of retirement. Persons retiring before the pay commission cut-off date get lesser pension than those retiring after that date.

Recently, while replying to a Parliamentary query, Raju had stated that government had accepted several recommendations of a Committee looking into the 'one rank one pension' demand to improve benefits of armed forces pensioners.

Bhopal, Aug 24 (UNI) The Indian Ex-Servicemen Movement has taken exception to the Congress ESM Welfare Cell alleging that veterans carried fake medals for depositing to President Pratibha Devisingh Patil in protest against the Centre not looking after its defence forces that have been ''pillars of strength'' for Indian democracy.
The President did not receive the delegation, which returned with the medals.
''The statement is dangerous and is sending a wrong signal to the nation. Just imagine how it would have hurt a Shaurya Chakra recipient martyr's mother who was part of the delegation. We were carrying 6,000 medals including those with which war heroes were decorated,'' IESM Vice-Chairman Major-General (Retd) Satbir Singh, Sena Medal, told UNI over telephone.
IESM Chairman Lieutenant-General (Retd) Raj Kadyan, Param Vishisht Seva Medal, led a delegation to Rashtrapati Bhavan on Sunday to deposit the medals and submit a memorandum signed in blood.
In a letter to the President, the veteran said, ''it is earnestly hoped that the Supreme Commander would relent and receive the delegation in person. However, should that unfortunately not happen... the delegation would return without depositing the medals and the memorandum.''
''The Cell also alleged that fake blood was utilised to ink the memorandum while the truth is I was among the first to donate and a prestigious laboratory's employees were also present on the scene to supervise the blood donation. I beseech the collective conscience of the nation not to berate the services,'' Maj-Gen Singh appealed.
The recent judgements of the Supreme Court, high courts and Armed Forces tribunals clearly reveal the ''grave injustice, apathetic attitude and arrogance of the Government and the bureaucracy,'' Maj-Gen Singh said.
The fact that the all-party Standing Committee on Defence -- after taking into consideration the reasons given by the Centre for not accepting veterans' main demand of One Rank One Pension -- has strongly recommended grant of OROP to defence personnel holistically in its report tabled in Parliament on May 7, proves the genuineness of their demand, he added.
The collection of medals and signing of the memorandum took place
at Jantar Mantar from 1100 to 1400 hrs.

Very Good despite the fact it was only audio of Gen Satbir and not Video. His booming voice and clarity of points were very good.

Subsequent to that in my browsing I found a programme on OROP in Times Now at about 1035 p.m. Gen Kadyan, Col Inderjit, Gen JFR Jacob and Mr Salve were there. Very good programme to bring out the issue of OROP. Very heartening to hear Mr. Salve supporting our cause and willing to extend his support. He only had a point that the returning of medals was not correcct since these medals are given to the soldiers by the people of India and not any individual in the Govt. Gen Kadyan did not get a chance to respond to that immediately. But when he did get a chance to respond he thanked Mr Salve for his support. IT IS UNFORTUNATE THAT HE FAILED TO CLARIFY THAT THESE MEDALS ARE NOT RETURNED BUT ON THE OTHER HAND THEY ARE DEPOSITED WITH THE SUPREME COMMANDER AS A FORM OF PROTEST TILL WE GET OROP.

I wish he had done that.

‘वन रैंक, वन पेंशन’ की मांग को लेकर देशभर के 2000 से अधिक पूर्व सैनिकों ने रविवार को राजधानी में प्रदर्शन किया और इस संबंध में राष्ट्रपति प्रतिभा पाटिल के नाम एक ज्ञापन सौंपा। जंतर-मंतर पर प्रदर्शन के बाद ये पूर्व सैनिक 6 हजार मेडल और 1.25 लाख पूर्व सैनिकों के खून से हस्ताक्षर युक्त ज्ञापन राष्ट्रपति को सौंपने पहुंचे थे, लेकिन ‘महामहिम’ से मुलाकात नहीं हो सकी। इस कारण वे अपने मेडल तो वापस ले आए, लेकिन मांग से संबंधित ज्ञापन राष्ट्रपति के प्रतिनिधि को सौंपा।

पूर्व सैनिकों के योगदान का अपमान
इंडियन एक्स सर्विसमैन मूवमेंट के चेयरमैन रिटायर्ड जनरल राज कादयान और उप चेयरमैन सतवीर सिंह ने कहा कि ‘वन रैंक-वन पेंशन’ को लागू नहीं कर देश में पूर्व सैनिकों के योगदान का अपमान किया जा रहा है। हम पिछले 26 साल से यह मांग कर रहे हैं। पूर्व सैनिकों की विधवाओं को इसके कारण कम पेंशन में गुजारा करना पड़ रहा है। उन्होंने कहा कि सीनियर रैंक के सैनिकों को क्लर्क के बराबर ओहदा देना गलत है। पूर्व सैनिकों की मांगों को सुनने के लिए सैनिक कमीशन गठित किया जाना चाहिए। यदि हमारी मांगे जल्द पूरी नहीं की गईं तो पूरे देश में आंदोलन तेज किया जाएगा।

I, as a young Signals Officer was sent to Wellington to provide communications for 'Telephone Battle' excercises in 1952. For a month or so I was put up in the Nilgiri Bungalow, where the other occupants (all singles) were then Majors Jacob, Furtado, and Munshi. Gen Jacob commanded the Arty School during partition, was it then a Major's Command?

I was in Calcutta till Dec 70 and was in regular touch with Gen JS Arora, the Army Commander, who used to go round to the Quality Assurance detachments under my command at Philips, Union Carbide, Fort Gloster, J Stone & Co. etc. His visits to my unit every alternate Saturday had become a ritual.

I opted for premature retirement, which was first refused and later arranged by Gen Arora. During that time Brig Bhasin was the CSO. Gen Jacob himself drafted my application for premature retirement as requested by Gen Arora. I often met ran into him at shops dealing in second hand goods and antiques around Russel Street; I was looking for furniture and he for antiques. He may not remember me because I became acivilian when the war was being fought in Bangla Desh. I ran into him a few times at the India International Centre and at Som Vihar and he did not place me. I would seek his pardon for my impertinence.
I was privy to few things during informal chats with Gen Arora, which do not quite tally with Gen jacob's account as given by him in the interview with Karan Thapar a few months back. It is intriguing that in the inteview with Karan Thapar, there was hardly any mention of Gen Arora and an impression was created that he was getting orders from Field Marshal Maneckshaw and did all the stategic planning and took all crucial decisions resulting in the historic victory. A replay of the interview would probably show this.

I am a small fry and was hesitant to raise these doubts. Perhaps Gen Jacob may be requested to throw some light on these ponts to shut up doubting Thomases like me.

This TV Debate was of special interest to us veterans.

Manu Singhvi Congress stated that he was not aware of any of the cases where verdicts were given by the Supreme Court in favour of the Armed Forces and on which the govt had appealed for review instead of graciously accepting the same. He agreed on TV that he would personally look into each of these and take them up to have them speedily resolved.

I suggest a delegation of IESM's senior diginitaries along with our legal experts and accompaqning documents call on him within the next week along with a representative of 'TIMES NOW' and on camera request him to sort this out.

We do not elect our Presidents but have a weird way putting them in the tax payer funded Presidential Palace and my memory is very strong how she got there. How shameless they are? The job of the Army is to protect the country against any foreign aggression and not to be used as and when required for odd civilian jobs. In the west where Armed forces are
well valued, respected and are totally bar from any such odd use even during emergency needs. Our Army need to take a stand and just need to do that.

Dear Veterans,
A great show !! Ended with an insignificant event of our Supreme commander, as expected, not obliging to receive the medals. Never the less, the show to my mind has been modestly described by Col RPC, who estimated the strength to be around 1,500 to 1,800. Our compliments to him on his versatile coverage of the event.
I watched the 'Times Now' News at 9 pm, with the following banners streaking below:-
a. More than 5000 ESM assembled to deposit their Medals.
b. The ESM claimed that they were treated shabbily.
c. Angry about the Pay hike of the MsP.
d. Demanded OROP which has been promised time & again by various parties.
e. ESM were deprived of their legitimate rights
It showed Lt Gen Raj Kadyan, Maj Gen Satbir Singh, Maj Gen Jaini & a couple of other Veterans voicing their concern.
Not a single instance of unruly behaviour was reported by the media. Speaks volumes about the manner in which the Members of the Governing Body conducted this event.

‘Grant of unequal pay in the same rank
is a violation of Article 14 of the Constitution'Highlighting the plight of ex-servicemen, especially wives of deceased personnel, several hundreds former soldiers and officers on Sunday collected medals and submitted a memorandum to the President seeking ‘One Rank, One Pension (OROP)'.
Under the Chairmanship of Lt. Gen. (retd.) Raj Kadyan of Indian Ex-Servicemen Movement (IESM), former soldiers and over 300 women assembled at Jantar Mantar here in support of the demand.
“Some 6,000 medals have been collected to be returned to the President of India, the supreme commander of the Armed Forces, and we submitted a memorandum containing 1.25 lakh signatures in blood at the Rashtrapati Bhavan on Sunday,” IESM vice-chairman Major General (retd.) Satbir Singh told The Hindu.
Plight of women
Expressing anguish over the plight of wives of deceased jawans who have not got the benefits of an earlier raise given by the government, he asked how a woman can take care of the needs of a family with a pension of Rs.3,500.
He said the IESM Chairman had sought personal audience from the President to meet a delegation on Sunday; but since that did not happen, it was decided to hand over the memorandum at the Rashtrapati Bhavan and not the boxes of medals.
Gen. Satbir Singh said the ex-servicemen are also hurt that despite the recommendation by the Parliamentary Defence Standing Committee in May 2010, asking the government to consider afresh the OROP issue, nothing has been done.
On the other hand, he said, reports suggest the government is considering raising further the salaries and allowances of Members of Parliament in the light of recommendations of a Joint Parliamentary Committee, all in a matter of few days.
Congress MP from Punjab Pratap Singh Bajwa told The Hindu that he had raised the issue in the Lok Sabha last week stating that unequal pension exists even after the “so-called parity” in pension to Personnel Below Officers Rank.
Inequality
He said a soldier who retired before December 31, 2005, with parity in pension with effect from January 1, 2006 gets Rs.5,523 a month while a solider who retired after January 1, 2006 with same length of service gets Rs.8,700 a month.
Citing the Babu Ram Dhiman versus Union of India case, he said the Chandigarh bench of the Armed Forces Tribunal ruled that the grant of unequal pay in the same rank was a violation of Article 14 of the Constitution and that the State cannot lay down different criteria for grant of pension for same rank of officers on the basis of the cut-off date of retirement.
He urged the Defence Minister to reconsider the OROP issue and not compare them to civilian counterparts since their terms of service and risk the armed forces personnel face, in discharge of their duties with pride and honour, are different.

It seems the OROP case from the below, had reached the Supreme Court in our favour with Rank Pay.

I casually met Mr Brajesh Misra at the Gym few days ago. He has a Chanakya mind like his boss Vajpayee, and discussed some issues informally, and I mentioned the OROP matter and he seemed unaware and was good to say he will mention this.

On my congrats for achievements like Nuke blasts and Sikkim recognition and economy build up he modestly said he was lucky to be both NSA and PPS to PM. I have read Sonia..... A biography by Rasheed Kidwai. It discusses how India runs and NSA issues. The NSA post can be one of the most powerful posts and depends on the personality. I get the feeling PM is missing MK for internal issues as Harvard educated Chidmabaram has no military and intelligence experience and intelligence is key for internal matters and needs Chanakya stuff.

Surely our ceremonial President, learned PM and his fine IFS NSA and powerful Sonia and the responsible Chiefs know all about this judgment and returned medals and are concerned to be fair. I know ESM and Navy Foundation have done a lot and are pursuing. Thanks.

This interested me.

I consulted a fine Constitution lawyer who helped me and Brig RP Singh JAG to co author the book on Vishnu Bhagwat's sacking via Art 311 and learnt some Constitutional law that dictates this country and its fine poor and ordinary people. The high and mighty know how to flout with money power, and in courts where Lawyers cost the earth and I need not elaborate. Read White Tiger. GOI lawyers always appeal not so much for the case but to earn fees and GOI is India's biggest litigant.

I learn normal appeal in SC is a Review Petition which GOI feels it may not get in this case ........so an IA seeks to modify a Judgment and is used only in exceptional cases eg Bhopal Gas Case etc where gross injustice has been done. Have we done gross injustice to Government by serving the nation. Think it over.

As far as I am concerned, this is cheating those who served this nation in tough days and wars including Kargil. Our course mate Gen VP has told us a lot of how he and Chiefs interacted with PM Vajpayee, my hero of India's nuclear blasts and the rise of India. I hope current Chiefs( Integrated Service HQs) and their JAGs have been consulted or what is military law branch for? And what are our Chiefs( Our Mai Baps) if they have no say in this important legal matter at this juncture...... surely when PM meets Chiefs they can explain how retired Jawans are doing, though this case is for Rank Pay but could benefit them ?

Or is GOI teaching military how to disregard Supreme Court judgments by hook or by crook. I pray the Judges see this as we do at a time when MPs want to treble their pay. I say this more for our Jawans, Airmen and Sailors to try get OROP ..... They are true India and now with exercises world wide, the world military knows what the average poor Indian jawan is capable of on a pittance.

In need, Chanakya tells the King the warrior is more important ...... but who reads Chankaya. In two strategy seminars on Raja's fine path breaking book on Scenarios Chanakya got mentioned only once in passing........we quote westerners now, not even Sun Tzu which Admiral Russi Ghandhi taught us to use and China uses to the hilt. He did a thesis in Staff College and his ship always won the Cock.

In passing I also believe that Art 311 read with section 15 of the Navy ACT BY WHICH THE WAR ROOM leak officers, and many others including Vishnu were dismissed needs legal direction to be in consonance with Art 14.

It is wrong that RM on advice / collusion with a Chief be the final authority to dismiss an officer called removing President's Pleasure and no appeal or pension. In USA there is Mast Punishment and UK has no written constitution and no 311, which Justice Shah recommended to Nehru to delete but Nehru was worried of coups.

Many feel the Cabinet (under Art 74 and 14) should apply mind and approve such dismissals of Capts and above. Then no appeal may lie. We pride our democracy but a Senior officer or a Chief like Vishnu is denied this totally by 311 and has to beg for pension. For details read our book which George Fernandes banned for reasons I now know. Details of the full operation are public.

We are emotional people as I proved in Indians Why We Are What We Are. So this massive power with RM alone is dangerous especially if he or GOI is threatened for disclosure in inquiries or acts emotionally. It has also been used by Chiefs/ GOI to threaten and make officers resign on hormonal issues and India Today has reported this some years ago. I just learnt from News X where Vishnu Bhagwat also spoke on TV that the cost of the Scorpene project has jumped by Rs 4870 crores and further delayed .........4000 crores is now chicken feed for Gorshkovs and Scorpenes with no blame on MOD, but OROP at some Rs 1500 crores is too much ? We are retired.

I append details of the IA you may have already seen and hope it is correct as I got it off the net and look to Sukhjinder and others fighting the cases and for War Room leak sufferers, to tell me if I have erred on legal facts, and tell us our chances for Rank Pay.

Its pouring in Delhi ... no golf ......hence this intrusion and CWG venues are flooded. Wish we could send this rain to Bihar and Jharkand as in every rain Delhi becomes a swimming pool with traffic snarls and the traffic lights do not work. Pakoras sell better then, and the rich carry Computers with Protons and mobiles are connected 24X7 in virtual BMWs. Just saw on TV Mayawati has given in to agitating farmers who burnt buses etc and saw the same on TV for Kashmir which made PM give Azadi and wonder how it will pan out ........Retired Uniformed will never agitate but cogitate.

I wanted to render whatever help I could in IESM struggle for 'OROP' and other related issues concerning the Indian Ex-servicemen. I know IESM needs funds to continue its struggle and also needs appropriate legal advice.

Whereas I am always available for any legal advice for whatever it is worth, I also have a proposal, if you find it is workable, to help generate some funds for the IESM. In my capacity as a lawyer having some experience, I have a proposal as given in the succeeding paras.

Many a litigant run to the courts when faced with a problem. They think they have a grievance, whether they have it or not. They contact the lawyers and pose their grievance. Many a lawyer mislead them showing rosy paths. Ultimately the sufferer is the litigant. By the time he realises he has lost a lot of money.

I propose to give free legal advice through internet.

However, there shall be a condition. I propose that before I give my advice the querist, if an officer, should pay a fee of Rs. 1000/- for any query, Rs. 500/- if JCO and Rs. 200/- if an OR to be paid to the IESM by way of demand draft sent directly to the IESM HQ. On the IESM confirming having receipt the demand draft I shall give my legal advice to the querist.

I may venture to say that the queries may not be limited to service matters alone. I can render advice in matrimonial, property, succession, consumer law, unfair trade practice, suits for damages and many other fields too. I have adequate experience in these fields.

You may like to suggest a different approach or an alternative method how I can help IESM generate funds.

Dear All, 1. Brig Hardip Ghuman and self held a meeting with HH Governor of Punjab in his office in his capacity as President of State Sainik Board and Sainik Welfare. 2. The meeting was organised through office of Director Sainik welfare Punjab. 3. Following Points were Discussed. 4. Instructions for facilitating Registration and Casting of Votes by the Serving Soldiers at the place of their Posting. HH was briefed that how serving soldiers were denied their constitutional right to vote for 60 years.Now that they have been permitted to vote at the place of their posting,there are many hurdles being created by vested interests so that they do not vote.Even agencies like MOD,EC and state machinery is involved in not placing a good system in place whereby these soldiers get registered on being posted and they are facilitated to vote.HH was informed that during last assembly elections out of 12 lakhs probable voters only 13000 voters were registered and only those could vote. The documents obtained under RTI from the MoD didn’t convince the President RSB Punjab as he stated he was on the committee that looked into this issue. The DO letter of Rajya Raksha Mantry (as RM) Shri Arun Singh of 20 Jan 1987 addressed to the PM was placed before the President RSB Punjab which stated quote ‘This subject was not discussed in the Group of Ministers (desired by the Union Cabinet), because we were of the view that the Running Pay Band, if accepted, would automatically mean point-to-point fixation. However, Finance Ministry expressed their dissent with point-to-point fixation when we approached them to finalize issuance of orders on the presumption that Group of Ministers’ view on Running Pay Band would find acceptance with the Cabinet. HH asked for the brief and assured us that he will ensure that all systems are created to ensure that all soldiers are registered as voters at the place of their posting.Brig HS Ghuman has crried out great job on this issue and he deserves our praises and we all must educate our firends and children serving in Defence Forces.Only Power of Vote of Serving and retired will bring Govt on to negotiating table one day for OROP. 5. Denial of Payments of dues of Rank Pay pensioner Benefits Given by 4th pay Commission.HH was briefed as how by design MOD denied us benefits of Rank pay which was authorised to us by Min Fin and duly approved by GOM.How MOD told lie about it even to GOM and PM.How one major fought for it and won the case .later large number of officers went to various courts and Supreme court finally ruled in favour of us ,dues to be paid with 6% interest.How against all ethics disgracefully MOD has gone to supreme Court for review of their decision. HH assured us that he will definitely speak to RM on the issue and he was sure that even supreme court is not going to change its decision for such an genuine case.
6. Armed Forces Special Powers Act. The real problem is Political differences promoting Separatism possibly on behalf of External Enemy of our Nation & poor Civil Administration for which amending this Act would be the biggest mistake. The President RSB Punjab assured that the Govt. of India has no intention whatsoever to dilute this Law since it has serious repercussions.7. Complimentary Rail Pass to CHAKRA Series of Awards by the President of India. The President RSB agreed to take up the matter with the Railway Minister to remove the discrimination for travel by Shatabdi Express Trains to Shaurya Chakra Awardees by the President of India We also discussed large number of other issues with the Governor.HH was of the view that Veterans deserve the same respect as our Serving soldiers.We also discussed with him ways and means of tackling J and K problem by registering serving soldiers and PMF men when they are posted there.He was appreciative of all our suggestions and looked forward to more discussions. Following for your info

Short Brief of Case (Rank Pay Anomaly of 4th CPC, due to deliberate incorrect implementation by MoD) so far.

Vide order dated 8.3.2010, the Hon’ble Supreme Court was pleased to pass final orders in the T.P. (Civil) No. 56 of 2007 and after transferring, the Writ Petitions pending before the High Courts of Kerala, Andhra Pradesh and Allahabad were allowed and W.P. (Civil) Nos. 96 of 2009 and 34 of 2009 pending before the Hon’ble Court were also allowed. The Hon’ble Court also allowed the application for intervention in T.P. (Civil) No. 56 of 2007.

After hearing detailed arguments, the Hon’ble Court agreed with the judgment dated 5.10.1998 passed by the learned Single Judge of the Kerala High Court in O.P. No. 2448 of 1996 and the order dated 4.7.2003 passed by the Hon’ble Division Bench of the Kerala High Court in W.A. No. 518 of 1999 and while upholding the aforesaid judgments and reasoning, directed to pay the rank pay to officers of the Armed Forces retrospectively with effect from 1.1.1986 and also directed to pay 6% interest p.a. accordingly.

Against the aforesaid order dated 8.3.2010, Union of India, the Applicant, has filed an interlocutory application (I.A.) for directions seeking modifications/ directions/recall of order dated 8.3.2010. As advised by our counsel no such provision exists in the Supreme Court to file an IA. In response to this, the RDOA has filed a detailed and comprehensive counter affidavit in the apex court. As per directions of the court UOI will be given four weeks time to file
rejoinder before the case gets listed for disposal.

Off late there have been instances wherein officers who are ill informed about the case have been floating papers / writing to corridors of power / seeking to go to the Supreme Court to vacate the appeal filed by the UOI. Such hasty and half cooked actions will only complicate matters and lead to further delays. RDOA wants to assure all veterans that thorough research has been done on the case before resorting to litigation. Chances of the case floundering are remote,
but if people file litigations in their exuberance on the subject matters the case may go on a tangent and result in loss of benefits.

It is therefore requested that all veterans should refrain from writing / going in for litigation on any issue / point related to the IV Pay Commission rank pay anomaly case.

Your cooperation is highly solicited. There are no brownie points to be scored.

Some unscrupulous lawyers in Chandigarh and other cities are trying to mislead retired Defence Officers regarding the Rank Pay Case, the 4th Pay Commission anomaly case. The sad part is that some of these lawyers are ESM or they are being helped by ESM to rope in innocent retired officers to file individual cases for their Rank Pay dues. Inspite detailed information on the subject being disseminated by "REPORT MY SIGNAL" and latest updates being given by ESM websites and ESM Groups, retired officers are falling prey to dirty tricks of such lawyers.

The aim of this email is to save innocent retired Defence officers from such traps.

The organisation RDOA was created with the sole aim of fighting against the deliberate injustice done by MoD regarding the Rank Pay after the 4th CPC report was submitted. The RDOA has also been attending to many other ESM welfare related jobs, and has been doing a commendable job.

4th CPC Report introduced Rank Pay for officers for the first time in pay structure of Defence Services.

As per the 4th CPC Report, the Rank Pay was over and above the salary fixed for officers. Some clever Babus deliberately manipulated the figures, deducted the Rank Pay from the salary fixed, thus reducing the salary fixed and then adding the amount granted as Rank Pay. Net result was that the legitimate additional Rank Pay amount was denied to the officers. It was probably done to ensure that Defence Services officers remain lower in status to their ‘equivalents’ in IAS and other Central Services.

The story did not end there.

Since the total pay of officers was cleverly lowered at the time of 4th CPC, it also affected the basic salary fixation of 5th CPC and 6th CPC.

Dear Kameshwar,

We may not have had the good fortune to have been acquainted either in uniform or in retired life and now settled miles apart. Your mail (forwarded by a dear friend and course-mate) was touching and spoken as a true soldier. What many forget is that "independence" of an individual is limited to the perimeter of one's nose. After which "independence" of others commence. From the stories that I heard from my father (also a vet of IN now late) I shudder to think that those who received independence on a platter cannot fathom the meaning of being under British Yoke. You have penned albeit few lines but have raised the same serious question of propriety and decency. All individuals who criticize are doing so mainly either to flaunt their egoistical superiority or are plain jealous at the accolades received by "pillars" of IESM. Cast them aside, and, let them drift.........

2. Politeness seems to be a thing of past tradition and now feel they have "freedom" to express their thoughts (may be with malice, may be guttural, may be obnoxious) but fail to acknowledge that "if you have nothing to do then don't do it here". Unsupported, unqualified criticism is a trait observed in many Indians. So friend do take heart. You may find yourself amongst like minded individuals albeit a distance apart. Truth is something which cannot be hidden and blurred. Keep at it.

3. Do keep up your good work. God Bless, wish you a happy, peaceful Independence Day (do for the time being set aside PMs speech from Lal Killa) and do enjoy the painful strides you have taken thus far and will do so in future.........................

It pertains to an ESM rally being held at Jantar Mantar Road, Near Jantar Mantar, New Delhi, on Sunday, 22 Aug 10.
Help from you all is essential to make this rally a grand success.

How Can You all Help.
1. Please get in touch with all the media persons you know and ensure that maximum possible coverage is provided to the rally planned at Jantar Mantar.
We need the TV coverage and the print media coverage. Please leave no stone unturned to muster media support.
Kindly do not expect to be approached individually by HQ IESM to seek your help for media.
You all are part of this mass movement for Justice for Defence Services so kindly act without personal request being made to you.


2. Those of you living in NCR and around, should join the ESM rally at Jantar Mantar Road, on Sunday, 22 Aug 10, from 11.00 AM to 3.00 PM.
We are also trying to muster ESM from other states for this rally, but we expect you all living in NCR to turn up in big numbers.
Not only you and your family members should join, but motivate others also to join in.
Drinking Water and simple tea arrangements are being made at the site.
Police has been informed to maintain law and order.
The rally will be entirely peaceful and in keeping with the military ethos.
We all are soldiers. So don’t be cowed down by bad weather, if the weather happens to be bad.

3. How To Reach The Rally Site.
a. A map of the area is attached.


b. Best way would be to come by Metro to the Patel Chowk Metro Station. The rally site is just 5 to 7 minutes walk from the Metro Station.
Clean toilet facilities are also available at Patel Chowk Metro Station.


c. If you are coming by own transport, park the vehicle at the underground parking of Palika Bazar at Connaught Place. From there cross over to Parliament Street through the subway. On Parliament Street, go pass the Jantar Mantar. When you reach the Parliament Street and Tolstoy Marg Crossing, (Tolstoy Marg connects Parliament Street to Janpath and goes beyond), turn left along the Jantar Mantar boundary wall. After you walk for another two minutes – you will find Jantar Mantar Road on your Right and you will see prominent shamianas of the Rally. Jantar Mantar Road is almost parallel to Janpath, in between Janpath and Parliament Street. You may also approach the Rally site from Janpath or Ashok Road, if you know the place well. Other good parking places are the Patel Chowk Metro Station or Park Hotel on Parliament Street. Patel Chowk Metro car parking is easiest to approach from the Ashok Road. I may remind you that on the Rally Day the traffic on the Jantar Mantar Road is not permitted, unless you come very early in the morning – so plan parking as suggested above.


d. If you come by Metro to Patel Chowk, come out from the exit towards Jantar Mantar Road, come on two the Jantar Mantar Road and look to your left – you will see the ESM Rally Shamianas 50 metre away.
Friends kindly appreciate that just a few members of IESM, no matter how hard they work, cannot get justice for all the ESM.
We all have to heave along with them and give them full support and boost up their morale.

Dear Veterans,

It is obvious that the words of Veteran Hony Lt Kameshwar Pandey, were from his heart. One of the original members of IESM right from its inception, his singular contributions & achievements for the cause of IESM is morale booster for all of us.

There are members who offer constructive criticism & many of their views are taken in the spirit they are projected. I am not mentioning the direct insinuation by a Veteran against our VC, because I do not want to elevate his remarks to a subject worthy of discussion. An extract of my mail pertaining to the TV discussion, "Defence Watch" is given below.

The relevance of IESM cannot be wished away either by the Govt or by other ESM Organisations. Praveen Davar, Secretary, AICC, has projected a veiled threat of forming of a new ESM outfit, named Indian Ex-Servicemen Association (IESA). May be it is to thwart any attempt of ESL & IESM converging on at least some of the issues, as evidenced in the TV show. So, we will have IESL, IESM & IESA.

What ever may be the intention of the originator of such schemes, which are directed to ensure a split amongst the ESM Organisations, the fact remains that it is the IESM which has created such a psychological impact on the dormant ESM community, which the Govt is not able to ignore.

Therefore, we can rightfully claim the title of the "Voice of the Veterans".

May I humbly suggest that, hereafter, we make our letter head as given below:-

This was the first time that the two stalwarts from IESL & IESM faced each other in a discussion, not to fight each other, but to lay a path of coexistence. Brig Gulia was there, as a matter of right. He has the numbers & the recognition by the Govt. Whereas, Maj Gen Satbir Singh was there, due to the psychological impact the IESM had made with much smaller membership base. In a span of couple of years, IESM has become the "Voice of the Veterans". The result is obvious. The Govt cannot ignore its presence. Do the numbers really matter?"
